EU Law Team of D. Dobkowski LP Law Firm offers legal advisory services pertaining to various aspects of functioning of private and public entities on the basis of EU regulations.
These include, in particular, analyses and opinions regarding conformity of legal acts and bill drafts with EU law. The Team has been engaged in drafting expert opinions for the Committee of European Integration and the Ministry of Foreign Affairs regarding, inter alia, transport and tax law.
Our EU Law Team possesses extensive experience in conducting legal proceedings and disputes touching upon or based on the EU law. It entails proceedings before EU institutions, including administrative (European Commission) and judicial bodies (Court of Justice, General Court, Civil Service Tribunal), as well as agencies (Office of Harmonization for the Internal Market). In addition, the Law Office renders legal advisory services concerning disputes and proceedings before Polish civil and administrative courts and bodies where cases involving the EU are brought.
We provide comprehensive services adapted to the needs of our Clients, including advisory, drafting of motions, applications and complaints, as well as representation in the course of proceedings or disputes. Members of the Team have been dealing with complaints to the EU courts concerning, inter alia:
- carbon credits,
- reimbursement of state aid,
- penalties imposed by the Commission in the proceedings connected with breach of the EU competition law,
- employee-related matters concerning the EU officers,
- production levies in the sugar sector and,
- Community trademarks.
The Team cooperates with foreign law offices forming the KPMG Global Legal network and law offices with expertise in the field of EU law, including FIDAL (Belgium) and Wildgens & Partners (Luxembourg).
The Team is headed by Mr Przemysław Kamil Rosiak, who graduated from faculties of law and international relations at the Warsaw University and obtained his LL.M. at the College of Europe in Bruges.
He gained his professional experience also as the head of EU Law Division at the Legal Department of the Ministry of Foreign Affairs. He participated in the screening process as the member of Polish delegation in the domains of “Transport” and “External Relations”. He represented Poland at the XXI UNCITRAL session in New York and V session of Inter-governmental Conference of Council of Poland-EU Association Agreement. In 2003 he was an intern at the Cabinet of the President of the then Court of First Instance in Luxembourg – Bo Vesterdorf. Between 2004 and 2006 he worked as a legal assistant at the Court of First Instance in Luxembourg.
He is an author and co-author of books and articles on EU law, including “Proceedings before the Court of Justice and the Court of First Instance. Practical aspects”, Wolters Kluwer Polska, Warsaw 2007, and “Fundamental rights in EU law and practice”, TNOiK, Toruń 2009.
In addition to his professional activities Mr. Rosiak conducts trainings in the domain of EU law for legal advisors, judges, governmental officials and entrepreneurs (Ministry of Foreign Affairs, Ministry of Labor, French Chamber of Commerce and Industry in Poland, Academy of European Law in Trier, Intellectual Property Law Postgraduate Institute of the Polish Academy of Science).
